Notice of Passing of Draft Plan, Official Plan and Zoning By-Law Amendment

TAKE NOTICE that the Council of The Corporation of the City of Thorold, at its meeting on February 24th, 2026, approved the application for Draft Plan of Subdivision, Official Plan Amendment, and Zoning By-law Amendment for the lands known municipally as 13030 Lundy’s Lane (legally described as PT TWP LOT 89; PT TWP LOT 89 RP59R-4846 PART 1 PART 2; and PLAN TWP PT LOT 89 RP59R 9206 PART 2), Township of Thorold, with consideration of all oral and written submissions made to Council before its decision.

By-law No. 11-2026 re-designates the subject area as being within new Site Specific Policy Area 14 by amending Section F1 to permit an increased maximum height, and to change the land use designations of certain lands illustrated on Schedule “A” attached hereto from “RM-Highway Commercial”, “RM – Employment – Prestige Industrial” and “RM -Residential” to “RM-Residential”, “RM – High Density”, “RM-Village Square Commercial” and “Open Spaces & Parks.

By-Law No. 12-2026 rezones the subject lands to Site Specific Residential ‘R1D (R1D-120)’ Zone, Site Specific Residential Three ‘(R3D-121)’ Zone, holding provision Site Specific Residential Four Holding ‘(R4B-122(H))’ Zone, holding provision Site Specific Residential Four Holding One ‘(R4B-123 (H1))’ Zone, holding provision Site Specific Residential Four Holding Two ‘(R4B-124 (H2))’ Zone, holding provision Site Specific Mixed Use Commercial Holding C6 ‘(C6-125 (H))’ Zone, Open Space – Parks and Recreation ‘(OS1)’ Zone, and Utility ‘(U)’ Zone.

THE LAST DATE FOR FILING A NOTICE OF APPEAL IS MARCH 25, 2026 AT 4:30 P.M.

A notice of appeal must be filed with the Clerk of The Corporation of the City of Thorold no later than 4:30 p.m. on March 25, 2026. The notice must set out the reasons for the appeal and must include the fee required by the Ontario Land Tribunal (OLT) for such an appeal. A certified cheque or money order made payable to the Minister of Finance must accompany the notice of appeal. A copy of an appeal form is available on the Ontario Land Tribunals website at https://olt.gov.on.ca/.

Only individuals, corporations and public bodies may appeal a by-law to the OLT. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the OLT, there are reasonable grounds to add the person or public body as a party.
